PER MANJUNATHA G., A.M : This appeal filed by the assessee is directed against the order of the learned Commissioner of Income Tax (Appeals) – NFAC, Delhi, dated 09.10.2025 and pertains to the A.Y. 2016-17. 2
At the time of hearing, the learned counsel for the assessee, Shri K.A. Sai Prasad, C.A., submitted that the assessee seeks to withdraw the present appeal, as a rectification petition filed under section 154 of the Income-tax Act, 1961 before the National Faceless Appeal Centre (NFAC), Delhi, against the impugned appellate order is pending for adjudication. He, therefore, requested that the appeal may be permitted to be withdrawn. The learned CIT-DR for the Revenue, Ms. Seema Meena, raised no objection to the said request.
We have heard both the parties and considered the request of the assessee. Since the assessee seeks to withdraw the appeal in view of the pendency of the rectification proceedings before the National Faceless Appeal Centre (NFAC), Delhi, and the Revenue has no objection, we permit the assessee to withdraw the appeal.
In the result, the appeal filed by the assessee is dismissed as withdrawn. Order pronounced in the Open Court on 14th July, 2026. श्री विजय पाल राि (मंजूनाथ जी) (VIJAY PAL RAO) (MANJUNATHA G.) उपाध्यक्ष /VICE PRESIDENT लेखा सदस्य/ACCOUNTANT MEMBER
