What did the Tribunal hold?

The Tribunal found merit in the assessee's argument that the profit estimation should be restricted to 1.5%, as voluntarily offered by the assessee. Therefore, the AO was directed to compute the gross profit at 1.5% on the total gross profit for the relevant assessment year.

What were the facts?

During a search operation, the assessee's business premises revealed unrecorded cash transactions of approximately Rs. 1,12,81,670/-. The assessee offered to tax a profit element of 1.5% on this amount, but the Assessing Officer treated the entire sum as unexplained expenditure under Section 69C. The CIT(A) directed the AO to compute gross profit at 3%.

What were the issues?

Whether the addition of unexplained cash expenditure should be based on the entire amount or a profit element, and at what rate should the profit be estimated.

Which sections of the Income-tax Act were involved?
