At the outset the Ld.AR submitted that there was a delay in filing appeal before the ld. CIT(A) of 134 days. He submitted that Ld.CIT(A) did not condone the delay by holding that no sufficient cause has been brought out by assessee for such delay caused.
2.1. The Ld.AR submitted that the representative of the assessee who handled the case had given an email id which was not with the assessee it was submitted that the then representative left the services of assessee and therefore, the notice issued were not 3
ITA 1594/MUM/2026 LAXMAN DADARAO SURYAVANSHI A.Y. 2023-24 communicated to the assessee. It was in the month of June, 2025 that the assessee realized the need to register email id on the portal. Subsequently a new email id was registered. The ld. AR submitted that even the department was aware of the fact that the material consisting of notice were not received by the assessee and therefore, the assessment order was received by the assessee on post on 17.05.2025 through the verification unit. 2.2. The Ld.AR submitted that assessee immediately filed the appeal before the Ld.CIT(A) and therefore, it may not be construed that there was a delay in filing appeal as the assessee received the assessment order on 17.05.2025. 2.3. Ld.AR submitted that in the impugned order Ld.CIT(A) did not appreciate these facts and therefore, the dismissal of technical ground as caused grave injustice to the assessee. The ld. AR thus prayed in the appeal to be decided on merits. We have perused the submissions advanced by both sides and the records placed before us. 3. It is noted that the Ld.CIT(A) has not decided the issue on merits even though assessee reasonably caused on behalf of the assessee for not able to file the appeal within the period of limitation. Hon’ble Supreme Court in case of Collector, Land Acquisition v. Mst. Katiji reported in 167 ITR 471 has held that substantial justice deserves to be preferred over technical considerations and that a litigant ordinarily does not stand to benefit by lodging an appeal belatedly. FurtherHon’ble Supreme Court in N. Balakrishnan v. M. Krishnamurthy reported in (1998) 7
ITA 1594/MUM/2026 LAXMAN DADARAO SURYAVANSHI A.Y. 2023-24 SCC 123 has held that, the length of delay is not material and that acceptability of the explanation is the only criterion. Respectfully following above we condone the delay in filing the appeal before the ld. CIT(A).
However, in the interest of justice the issue needs to be decided by the Ld.CIT(A) on merits. Accordingly we remit this appeal back to the file of Ld.CIT(A) with a direction to decide the issue on merits having regard to the evidences furnished by the assessee in accordance with law. The assessee is also directed to furnish all evidences and documents in support of its claim. The Ld.CIT(A) is directed to verify the evidences furnished by the assessee and to pass a detailed order on merits in accordance with law. Needless to say that proper opportunity of law must be granted to the assessee Accordingly, grounds raised by the assessee stands allowed for statistical purposes.
In the result, appeal filed by the Assessee stands allowed for statistical purpose. Order pronounced in the open court on 14.07.2026
