What did the Tribunal hold?

The Tribunal held that the reopening of assessment was based on borrowed satisfaction and a lack of application of mind by the AO. Furthermore, the interest paid on the loan was not debited to the Profit and Loss account but capitalized, and the loan itself was accepted by the Revenue.

What were the facts?

The assessee's case was reopened under Section 147 based on information that it took a loan of ₹80 lacs from Mr. Birendra Kumar Patni. However, the assessee had only taken a loan from M/s Samarohi Traders Pvt. Ltd. in a preceding year, on which interest of ₹9 lacs was paid during the current year.

What were the issues?

Whether the addition of interest on an unsecured loan is sustainable when the reopening of assessment is based on incorrect information and the interest was capitalized rather than charged to the P&L account.

Which sections of the Income-tax Act were involved?

Section 147,Section 148,Section 148A(d)
