What did the Tribunal hold?

The Tribunal held that the addition of Rs. 2,02,000 was unsustainable as the cash deposits were explained by prior withdrawals from retirement benefits and the Revenue failed to disprove the assessee's explanation. The addition for salary income was also unwarranted as it was duly reflected in Form 26AS and salary details.

What were the facts?

The assessee, a retired individual, deposited Rs. 2,02,000 in cash into his bank account, claiming it was from earlier withdrawals of retirement benefits used for loan repayment. He also had Rs. 1,82,175 in salary income. The Assessing Officer made additions for both amounts as unexplained cash deposits and unreported salary.

What were the issues?

Whether cash deposits in a bank account are unexplained when they can be traced to earlier withdrawals of retirement benefits. Whether salary income reflected in Form 26AS and provided details can be added as unreported income without discrepancy.

Which sections of the Income-tax Act were involved?

Section 69A

PER DR. B.R.R. KUMAR, VICE-PRESIDENT:

- This appeal has been filed by the Assessee against the order dated 29.09.2025 passed by the Ld. Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (NFAC), Delhi (hereinafter referred to as ‘Ld. CIT (A)’ in short), under Section 250 of the Income-tax Act, 1961 (hereinafter referred to as ‘the Act’ in short) for Assessment Year 2019-20. 2. The assessee has raised the following grounds of appeal:- “1. Learned CIT(A) has gravely erred in confirming AO order in making an addition of Rs. 2,02,000/- under section 69A of the Income Tax Act 1961 out of cash deposited into bank accounts.

2.

Learned CIT(A) has gravely erred in confirming AO order in making an addition of Rs. 1,82,175/- of salary income received during the year as unreported income.

3.

Your appellant prays to add, amend, alter, modify or delete any grounds of appeal at the time of hearing.”

3.

The assessee is a retired individual who opted for Voluntary Retirement Scheme (VRS) during the year under consideration. During the relevant previous year, the assessee received salary of Rs. 1,82,175/- for the period he remained in service and, thereafter, received pension of Rs. 1,18,824/-. Since the total income of the assessee for the year was below the maximum exemption limit, he did not file the return of income. It is submitted that the assessee had withdrawn cash from his savings bank account on various dates through self-cheques as well as ATM withdrawals. The said withdrawals were made out of the amounts credited to his bank account towards gratuity and provident fund received upon retirement. The cash so withdrawn was utilized for repayment of outstanding loans taken from relatives for the marriage of his daughter in the earlier years. After making such repayments, the surplus cash remaining with the appellant was redeposited into the same savings bank account. It is further submitted that the Assessing Officer, on the basis of the bank statement obtained under section 133(6) of the Income-tax Act, 1961, treated the cash deposits aggregating to Rs. 2,02,000/- as unexplained and made the addition accordingly.

4.

Aggrieved by the Assessment Order, the assessee preferred an appeal before the Ld. CIT(A). However, the Ld. CIT(A) dismissed the appeal on the ground that the assessee remained non-compliant and failed to furnish the requisite documents and evidences in support of his claim.

5.

The Ld. Counsel for the assessee submitted that the Assessing Officer failed to consider the cash withdrawals made by the assessee from the very same bank account during the relevant previous year, including the withdrawals preceding the corresponding cash deposits. It was contended that the impugned addition was made without appreciating the complete flow of funds reflected in the bank account. In support of the aforesaid contention, the Ld. Counsel for the assessee placed on record the following documents:

- 3–

1.

Bank statement of Bank of Baroda for the period from 01.04.2018 to 31.03.2019;

2.

Bank statement of State Bank of India for the period from 01.04.2018 to 31.03.2019;

3.

Salary statement/chart evidencing salary income of Rs. 1,82,175/- received during the relevant previous year; and 4. Form 26AS for Assessment Year 2019-20. 6 We have heard the rival submissions and carefully perused the material available on record. It is observed that the Assessing Officer made the addition of Rs. 2,02,000/- under section 69A merely on the basis of cash deposits reflected in the bank statement, without considering the corresponding cash withdrawals made by the assessee from the same bank account. The bank statements placed on record clearly support the assessee's explanation that the cash deposits were made out of earlier withdrawals from retirement benefits received on account of gratuity and provident fund. The Revenue has not brought any material on record to disprove the explanation furnished by the assessee. We further find that the addition of Rs. 1,82,175/- towards salary income is also unwarranted, as the said salary income is duly reflected in Form 26AS and the salary details furnished by the assessee. The Assessing Officer has not pointed out any discrepancy in these documents. Considering the facts of the case and the documentary evidence placed on record, we are of the considered view that the additions of Rs. 2,02,000/- under section 69A and Rs. 1,82,175/- towards salary income are not sustainable. Keeping in view the quantum and history of the case, we hold that no addition is called for. Accordingly, we direct the Assessing Officer to delete both the additions.

7.

In the result, the appeal filed by the assessee is allowed. The order pronounced in the open Court on 17.07.2026 - (RAHUL CHAUDHARY) VICE-PRESIDENT () Ahmedabad; Dated 17.07.2026 - 4– MV
