Before: SHRI R. K. PANDA & MS. ASTHA CHANDRA

For Appellant: Shri Tanaji Chavan (through virtual)
For Respondent: Shri Mithun Shete, CIT-DR

PER BENCH :

The above two appeals filed by the assessee are directed against the separate orders dated 12.02.2026 of the Ld. CIT(Exemption), Pune rejecting the application for grant of registration u/s 12A and grant of approval u/s 80G of the Income Tax Act, 1961 (hereinafter referred to as ‘the Act’) respectively. For the sake of convenience, both these appeals were heard together and are being disposed of by this common order.

ITA No.712/PUN/2026

2.

Facts of the case, in brief, are that the assessee filed an application in Form No.10AB on 05.08.2025 for registration of the trust under clause (iii) of section 12A(1)(ac) of the Act. With a view to verify the genuineness of the activities of

the assessee and compliance to requirements of any other law for the time being in force by the trust / institution as are material for the purpose of achieving its objects, a notice was issued through ITBA portal on 14.10.2025 requesting the assessee to upload certain information / clarification. The assessee furnished its compliance on 13.01.2026. Upon verification of the documents the Ld. CIT(E) noted that the assessee's earlier application filed in Form 10AB on 30.09.2023 was rejected on 14.02.2024 for which the assessee's provisional registration in form 10AC u/s 12A(1)(ac)(vi) of the Act dt. 01.06.2022 was also cancelled. As such, the assessee had no valid provisional registration u/s 12A(1)(ac)(vi) of the Act at the time of filing the present application. According to him, non-submission of the copy of the order of valid provisional approval 12AB of the Act by the assessee establishes the fact that the prerequisite of the provisions of clause (iii) of section 12A(1)(ac) of the Income Tax Act, 1961 is not fulfilled in this case. He accordingly rejected the application filed by the assessee for grant of registration u/s 12A of the Act and also cancelled the provisional registration granted earlier u/s 12AB of the Act.

3.

Since he rejected the grant of registration u/s 12A of the Act and cancelled the provisional registration granted earlier, he refused to grant approval u/s 80G of the Act.

4.

Aggrieved with such order of CIT(Exemption), the assessee is in appeal before the Tribunal by raising the following grounds:

3 ITA Nos.712 & 886/PUN/2026

1.

The learned Commissioner of Income Tax (Exemptions), Pune erred in law and on facts in rejecting the appellant's application for registration under section 12AB of the Income-tax Act, 1961. 2. The learned authority failed to appreciate that the appellant trust exists solely for charitable purposes and is engaged in genuine charitable activities for the benefit of the public. 3. The learned authority ought to have granted registration after considering the objects of the trust and the material placed on record regarding its activities. 4. The rejection of registration has consequently resulted in denial of approval under section 80G(5)(iii), thereby adversely affecting the appellant's ability to carry out charitable activities through public support. 5. The appellant submits that it fulfils the conditions prescribed under the Act for grant of registration under section 12AB and approval under section 80G. 6. The appellant therefore prays that registration under section 12AB and approval under section 80G(5)(iii) be granted in the interest of justice, equity and charity. 7. The appellant craves leave to add, amend, alter or withdraw any ground of appeal at the time of hearing.

5.

The Ld. Counsel for the assessee submitted that it fulfills all the conditions prescribed under the Act for grant of registration u/s 12AB and the approval u/s 80G of the Act. He submitted that all the details were filed before the Ld. CIT(E). However, he has not gone through the same properly. He submitted that in the interest of justice, the assessee should be given an opportunity to substantiate its case by filing the requisite details before the Ld. CIT(E).

6.

The Ld. DR on the other hand heavily relied on the order of the Ld. CIT(E).

4 ITA Nos.712 & 886/PUN/2026

7.

We have heard the rival arguments made by both the sides, perused the orders of the Ld. CIT(E) and the paper book filed on behalf of the assessee. It is an admitted fact that due to non-submission of the copy of the order of valid provisional approval u/s 12AB of the Act by the assessee, the Ld. CIT(E) held that the pre-requisites of the provisions of clause (iii) of section 12A(1)(ac) of the Act are not fulfilled. Further, he also given a finding that in spite of giving sufficient opportunities, the assessee could not satisfy the Ld. CIT(E) regarding the genuineness of its activities and compliance of requirements of any other law for the time being in force. Since it is the submission of the Ld. Counsel for the assessee that given an opportunity, the assessee is in a position to substantiate its case by filing the requisite details before the Ld. CIT(E) to his satisfaction, therefore, considering the totality of the facts of the case and in the interest of justice, we deem it proper to restore the issue to the file of the Ld. CIT(Exemption) with a direction to grant one final opportunity to the assessee to substantiate its case by filing the requisite details to his satisfaction and decide the issue as per fact and law. The assessee is also hereby directed to submit the details as called for by the Ld. CIT(E) on the appointed date without seeking any adjournment under any pretext, failing which the Ld. CIT(Exemption) is at liberty to pass appropriate order as per law. We hold and direct accordingly. The grounds raised by the assessee are accordingly allowed for statistical purposes.

ITA No.886/PUN/2026

8.

Grounds raised by the assessee are as under:

5 ITA Nos.712 & 886/PUN/2026

1.

On the facts and circumstances of the case, the rejection of the application filed in Form No.10AB under section 80G(5) of the Income Tax Act, 1961 may kindly be reconsidered. 2. The Appellant submits that it satisfies the conditions prescribed under section 80G(5) of the Act and is carrying on genuine charitable activities in accordance with its stated objects. 3. The Appellant respectfully submits that the application may kindly be examined on merits, considering the charitable nature of its activities and supporting documents placed on record. 4. The Appellant prays that approval under section 80G(5) may kindly be granted. 5. In the alternative, the Appellant prays that the matter may kindly be restored for fresh consideration in accordance with law. 6. The Appellant craves leave to add, amend or modify any of the above grounds at the time of hearing.

9.

After hearing both the sides, we find the Ld. CIT(E) rejected the application for grant of approval u/s 80G by observing as under:

6 ITA Nos.712 & 886/PUN/2026

10.

Since we have already restored the issue of grant of registration u/s 12AB to the file of the Ld. CIT(E) for fresh adjudication, therefore, we restore the issue of grant of approval u/s 80G also to his file for fresh adjudication with similar directions. The grounds raised by the assessee are accordingly allowed for statistical purposes.

11.

In the result, both the appeals filed by the assessee are allowed for statistical purposes.
