What did the Tribunal hold?

The Tribunal held that the service of notice under Section 148 is mandatory for assuming valid jurisdiction under Section 147. Since it was demonstrated that the notice was not served on the assessee at any of his known addresses, the Assessing Officer lacked valid jurisdiction to frame the assessment. Consequently, the assessment order was quashed.

What were the facts?

The assessee challenged an assessment order passed under Section 147 of the Income Tax Act, 1961, on the grounds that the mandatory notice under Section 148 was not served. The notice was issued to a village address where the assessee had not resided for 25-30 years, and it was not served at his office or residential address mentioned in his PAN details or returns filed prior to the notice.

What were the issues?

The primary issue was whether the assessment framed under Section 147 was valid when the mandatory notice under Section 148 was not properly served on the assessee.

Which sections of the Income-tax Act were involved?

Section 147,Section 148,Section 250

P a g e | 2 ITA No. 93/JPR/2026 Mahendra Kumar 29.12.2025 u/s 250 of the Income Tax Act, 1961,(hereinafter referred to as “the Act”). 2. Ground No.1 raised by the assessee is a legal ground challenging the validity of the assessment framed u/s 147 of the Act which reads as under:- 1. Under the facts and circumstances of the case, assessment order passed u/s 147 of IT Act, 1961 without service of notice issued u/s 148 is illegal & bad in law and be quashed. 3. The challenge to the validity of the assessment framed in the present case u/s 147 of the Act, is on the ground that the assessee was not served with the jurisdictional notice u/s 148 of the Act. Ld. Counsel for the assessee pointed out that the notice u/s 148 of the Act was issued at Village Utawal, Tehsil Ramgarh, Alwar, while the assessee’s PAN details mentioned the address as 13, Rajeev Colony, Alwar ,being his office address and 395 60 feet Road Fmanwali School Ke Piche, Alwar, as his residential address. It was pointed out thatthe said PAN was issued to him on 01.12.2009, while the notice u/s 148 of the Act was issued to the assessee on 30.03.2015.He further pointed out that, the assessee had filed the return of income before the issuance of notice u/s 148 of the Act for AY 2012-13 on 30.09.2012 and for AY 2013-14 on 05.10.2013, wherein, he had mentioned the address as M/s Koolwal Broker Agencies workshop Kedal Gunj Alwar. 4. As evidence for all the aforestated facts the following was filed before us:  Copy of the notice issued u/s 148 of the Act at paper book page No.5,

P a g e | 3 ITA No. 93/JPR/2026 Mahendra Kumar  copy of the PAN details of the assessee taken from the portal of the Income Tax Department placed before us at paper book page No.6 .  and the copy of the return filed by the assessee for AY 2012-13 and 2013-14 was placed before us at paper book page Nos.7 to 8.

5.

Ld. Counsel for the assessee contended therefore, that it was clear that there was no service of notice to the assessee at all since the assessee was not residing at the address at which notice was served in Village Utawal. He pointed out that, in his submissions made to Ld. CIT(A), the assessee had submitted that, he along with his whole family had left his ancestral village Utawal, Alwar, where the notice was served, 25-30 years back. In this regard, he drew our attention to page 7 of the Ld. CIT(A)s order, wherein, the submissions of the assessee objecting to a valid service of notice u/s 148 of the Act was reproduced.

6.

He thereafter, pointed out that the Ld. CIT(A) had adjudicated this ground raised by the assessee stating that the contention of the assessee is found to be factually incorrect and legally untenable, since the notice was issued at the address available in the PAN database. He drew our attention at para 7.2 of the order of Ld. CIT(A) in this regard. He contended therefore, that the Ld. CIT(A) had adjudicated the issue noting incorrect facts and therefore, his order needed to be set aside.

7.

Ld. DR however, relied on the order of the Ld. CIT(A).

8.

We have heard the rival contentions. The Ld. Counsel for the assessee before us, has fairly demonstrated the fact that the notice u/s 148 of the Act was neither served on the address in his PAN database nor on the address mentioned in his return of income filed for AY 2012-13 and 2013-14 which were filed before the issuance of notice u/s 148 of the Act for the impugned year. The ld. Counsel for the assessee has also pointed out, from his submissions made to the Ld. CIT(A) that he had left the village, where the notice u/s 148 of the Act was served 25 to 30 years back.

9.

In view of the above, it is amply clear that, no notice u/s 148 of the Act was served on the assessee in the present case. The finding of Ld. CIT(A), that the notice was served on the PAN database address, we find is factually incorrect.

10.

There is no dispute that for the assumption of a valid jurisdiction by the AO to frame assessment u/s 147 of the Act, the service of notice u/s 148 of the Act is mandatory. In the facts of the present case since it has been demonstrated that the jurisdictional notice u/s 148 of the Act was not served on the assessee at all, we have no hesitation, in holding that theAO had no valid jurisdiction asper lawto frame assessment u/s 147 of the Act. The order passed as a consequence u/s 147 of the Act, is not legally sustainable and is accordingly quashed.

P a g e | 5 ITA No. 93/JPR/2026 Mahendra Kumar 11. Ground of appeal No.1, raised by the assessee is allowed.

12.

Since we have quashed the assessment order, the grounds raised on merits in ground No.2, being academic in nature, need no adjudication. 13. In the result, the appeal of the assessee is accordingly allowed in above terms. Order pronounced in the open court on 21.07.2026
