These two appeals pertain to the rejection of application for registration u/s 12AB and approval u/s 80G of the Act. Since common facts are involved, both the appeals are being disposed of by a common order and ITA No. 4756/Del/2026 pertaining to rejection of application for registration u/s 12AB is taken as the lead case. 4. Brief facts are that the assessee filed application in Form 10AB on 16.02.2024 for registration u/s 12A(1)(ac)(iii) of the Act. A questionnaire was issued by the CIT(E) on 19.03.2024 calling for certain details / documents from the assessee. In response, only partial details were submitted by the assessee. Since the claim of charitable activities could not be verified in the absence of requisite details, the application was rejected by the CIT(E) vide order dated 21.08.2024. Aggrieved, the assessee is in appeal before the Tribunal. 5. Before us, Ld. AR has at the outset, requested for grant of one more opportunity to furnish requisite details before the CIT(E). 6. After hearing both the parties and in the interest of justice, we hereby restore the matter to the CIT(E) for fresh consideration after affording reasonable opportunity of being heard to the assessee. 7. Since facts and circumstances in appeal no. 4755/Del/2026 pertaining to rejection of application for approval u/s 80G are identical and connected, this matter
ITA No.- 4755 & 4756/Del/2026 Shaagird Foundaon is also restored to the CIT(E) for fresh consideration after giving due opportunity to the assessee. 8. In the result, both the appeals of the assessee are allowed for statistical purposes. Order pronounced in the open court on 22.07.2026
