ITO-12(2)(1) MUMBAI, AAYAKAR BHAWAN vs. HARMONY ADDITIVES PRIVATE LIMITED, GOREGAON EAST
In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal upheld the CIT(A)'s order, finding no infirmity in restricting the addition to 12.5% of the disputed purchases. The decision followed a precedent set in the assessee's own case for a prior assessment year.
What were the facts?
The Assessing Officer made an addition of Rs. 15,86,146/- on account of alleged bogus purchases as the assessee failed to provide submissions or details of the parties. The CIT(A) restricted this addition to 12.5% based on a previous year's order.
What were the issues?
Whether the addition on account of alleged bogus purchases should be fully sustained or restricted, considering the assessee's partial compliance and a prior tribunal decision.

Mumbai, Maharashtra - 400020. Goregaon, East, Mumbai, Maharashtra – 400063 PAN- AACCH0071R (Appellant) (Respondent) Present for: Assessee by : Shri M. Subramaniam Revenue by : Shri Dhreej Singh Baghel, JCIT. Date of Hearing : 17.07.2026 Date of Pronouncement : 23.07.2026 O R D E R Per : Narender Kumar Choudhry, Judicial Member:
This appeal has been preferred by the Revenue against the order dated 21.10.2025, impugned herein, passed by the Ld. Commissioner of Income Tax (Appeals), ADDL/JCIT(A)-2, Visakhapatnam (in short, “Ld. Commissioner”), under section 250 of the Income Tax Act, 1961 (in short, “the Act”), for the A.Y. 2011- 12.
We observe from the assessment order that the Assessing Officer, while noticing that the Assessee had neither furnished any submission nor provided any new address of the parties, from whom the purchases had allegedly been made and to whom notices
2 ITA No. 9513/M/2025 Harmony Additives Private Limited
under section 133(6) of the Act had been issued, made an addition of Rs.15,86,146/-.
Thus, the Assessee, being aggrieved, challenged said addition by filing the first appeal before the Ld. Commissioner, who, vide impugned order, took into consideration the fact that, in the Assessee’s own case for the A.Y. 2009-10, the Tribunal, vide order dated 11.09.2017 passed in ITA No.1103/Mum/2017, had restricted an identical addition to 12.5% of the value of the alleged bogus purchases. Accordingly, following the aforesaid decision of the Tribunal in the Assessee’s own case, the Ld. Commissioner restricted the addition to 12.5% of the disputed purchases of Rs.15,86,146/-.
Thus, the Revenue, being aggrieved, has preferred the instant appeal.
We have heard the parties, perused the material available on record and considered the rival submissions. The Ld. DR submitted that, during the assessment proceedings, the Assessee had failed to furnish the requisite submissions and supporting documents and had further failed to produce the parties mentioned in paragraph 3 of the assessment order, from whom purchases aggregating to Rs.15,86,146/- had allegedly been made.
Whereas on being asked, the Assessee drew our attention to the relevant documents before us and the para no. 2 of the Assessment order and demonstrated that the Assessing officer has specifically endorsed/referred to the filing of its reply in “TAPAL”, in the said paragraph.
We also compared the assessment orders pertaining to the year under consideration and the A.Y. 2009-10 and observed that, during the A.Y. 2009-10 also, the Assessee had made identical
3 ITA No. 9513/M/2025 Harmony Additives Private Limited
purchases aggregating to Rs.6,15,532/- from the same parties. In that year, the Assessing Officer had similarly issued notices under section 133(6) of the Act to the parties concerned, which remained unserved, and consequently made an addition of Rs.6,15,532/-.
The said addition ultimately came up before the Tribunal, who, vide order dated 11.09.2017 passed in ITA No.1103/Mum/2017, after considering the identical factual aspects, restricted the addition to 12.5% of the disputed purchases.
Thus, the Ld. Commissioner, following the aforesaid decision of the Tribunal in the Assessee’s own case, restricted the addition under consideration to 12.5% of the disputed purchases. Considering the peculiar facts and circumstances in totality, we do not find any infirmity in the conclusion drawn by the Ld. Commissioner. Consequently, the impugned order restricting the addition to 12.5% of the disputed purchases, is upheld.
In the result, the Revenue’s appeal is dismissed.
Order pronounced in the open court on 23.07.2026.
