What did the Tribunal hold?

The Tribunal held that the amendment regarding the validity of returns filed under Section 148 was effective from 01.04.2022, which was after the assessment year in question. It also noted that the CIT(A) failed to appreciate that the sale deed indicated agricultural land, which is exempt, and that the income offered was after considering capital gains and deductions.

What were the facts?

The assessee filed a return in response to a notice under Section 148. The Assessing Officer rejected this return, and the CIT(A) upheld this decision. The assessee argued that the return was valid and that the lower authorities failed to consider the nature of the income and the co-ownership of the property.

What were the issues?

The primary issues were the validity of a return filed under Section 148 for an assessment year prior to the amendment and whether the CIT(A) properly considered the nature of the income and the exemption for agricultural land.

Which sections of the Income-tax Act were involved?

Section 148,Section 139(1)

The brief facts of the case are that the assessee was amongst the non-filers of the return for the year under consideration and the Revenue was in possession of certain information pertaining to the transactions entered by the assessee during the year under consideration as under: i).
