What did the Tribunal hold?

The Tribunal restored both issues to the file of the Assessing Officer for fresh verification. The AO is to examine bills, vouchers, and ledgers for the 'other expenses' disallowance and verify the reconciliation for the service tax figure mismatch.

What were the facts?

The assessee bank challenged disallowances made by the AO and confirmed by the CIT(A) on account of 'other expenses' and alleged mismatch between service tax returns and income disclosed. The AO disallowed expenses due to lack of bifurcation and justification, while the CIT(A) confirmed a 25% ad-hoc disallowance. A further addition was made for alleged mismatch in service tax figures.

What were the issues?

Whether ad-hoc disallowances of 'other expenses' and service tax related income are sustainable without proper verification. The need for the assessee to provide complete documentation for expenses and reconciliation of income figures.

IN THE INCOME TAX APPELLATE TRIBUNAL DEHRADUN BENCH, DEHRADUN Before Shri Mahavir Singh, Vice President & Shri Sanjay Awasthi, Accountant Member ITA No. 262/DDN/2026 : Asstt. Year : 2017-18 Nainital District Coop Bank Ltd., Vs ACIT, Co-operative Bhawan, Nainital Road, Circle-2(1)(1), Haldwani, Uttarakhand-263139 Haldwani-263139 (APPELLANT) (RESPONDENT) PAN No. AAAAN1154F Assessee by: Sh. Pavan Kumar Nath, Adv. Revenue by: Sh. Mohan Lal Joshi, Sr. DR Date of Hearing: 20.07.2026 Date of Pronouncement: 28.07.2026

ORDER Per Bench: This appeal by assessee is arising out of the order of ld. CIT(A)/NFAC, Delhi in DIN & order No. ITBA/NFAC/S/250/2025- 26/1087205592(1), order dated 11.03.2026. Assessment was framed by ACIT, Circle-2(1), Haldwani for the Assessment Year 2017-18 u/s 143(3) of the Income Tax Act, 1961 (hereinafter “the Act”) vide order dated 25.12.20119.

2.

At the outset, ld. Counsel pointed out that the assessee has raised two grounds of appeal i.e. the ld. CIT(A) erred in upholding the disallowance on an ad-hoc and estimated basis at 25% at Rs.52,31,060/- out of the total disallowance made by

the AO of other expenses of Rs.2,09,24,241/-, without identifying any specific expenditure as non-genuine, bogus or not incurred wholly and exclusively for the purpose of business, as required u/s 37(1) of the Act. The second issue is regarding sustaining the addition at Rs.40,00,000/- on ad-hoc estimate basis being alleged mismatch between gross value of service tax return and income disclosed in the income tax return at Rs.1,27,56,490/-. The additions were made despite the fact that the assessee has furnished complete, detailed evidences demonstrating the entire reconciliation.

3.

We have heard the rival contentions and gone through the facts and circumstances of the case. As regards to the first issue, the Assessing officer made disallowance of expenditure claimed by assessee at Rs.2,09,24,241/- as the assessee could not file any bifurcation of nature of expenses and justification of expenses under the head “other expenses”. According to the AO, the unallowable expenses have been identified and added to the income of the assessee. The ld. CIT(A) also confirmed the action of the AO as the assessee has not discharged his burden fully as the detailed documentary evidence and branch- wise ledgers were not furnished by the Assessing Officer. Therefore, the ld. CIT(A) estimated the disallowance at 25% of the total expenses claimed by the assessee under the head

“other expenses”, for the reason that the assessee’s business is providing banking services, having multiple branches and it would not be reasonable to disallow the entire expenditure merely on account of partial non-verification.

4.

Now before us, ld. Counsel for the assessee pointed out that neither the Assessing Officer nor ld. CIT(A) has rejected the books of accounts u/s 143(3) of the Act and there is no basis provided for confirming the 25% of disallowance in respect of other expenses. It was claimed that the assessee furnished head-wise statement of other expenses, sample bills from major CBS/technology service providers and when it was pointed out to ld. Counsel that the assessee has not filed complete bills & vouchers for verification and other details, he agreed that for verification purposes, the matter can be remanded back to the file of the AO.

5.

The second addition is regarding the disallowance of Rs.40,00,000/- on ad-hoc basis out of the total disallowance made by AO of Rs.1,27,56,490/-. The Assessing Officer relied upon information reflecting the gross value of services in the Sales Tax return and tallied with the Income Tax return and without considering the reconciliation, he disallowed the entire expenses pertaining to gross value of service at Rs.1,27,56,490/- and ld. CIT(A) simply on estimate basis,

restricted the disallowance at Rs.40,00,000/-. The ld. Counsel before us pointed out that the assessee has filed detailed reconciliation of service tax figures which can be verified. When the matter of verification being required was pointed out to the ld. Counsel, he agreed that the matter can be restored to the file of the AO for limited purpose of such verification. When these facts were confronted to ld. Sr. DR, he could not controvert the above situation and specifically requested for verification of this amount and for that he also requested that matter can be restored back to the file of the AO.

6.

After hearing both the sides and going through the facts of the case, we are inclined to restore both these issues to the file of the AO. The AO will verify bills & vouchers and ledgers etc. and thereafter will decide this issue. As regards the difference in Sales Tax figure and Income Tax return figures in regard to value of services, the AO will verify the reconciliation submitted by assessee for which purpose the assessee undertakes to submit before the AO as and when called to do so. In terms of these observations, this matter is restored back to the file of the AO for fresh re-conciliation in terms of the above.
