Income Tax Appellate Tribunal, PUNE BENCH “A”, PUNE

Before: SHRI RAMA KANTA PANDA & Ms. ASTHA CHANDRA

For Appellant: Shri Pramod S. Shingte
For Respondent: Shri Rajesh Gawali, Addl.CIT-DR

PER ASTHA CHANDRA, J.M.:

The appeal filed by the assessee is directed against the order dated 23-12-2025 of the Ld. Commissioner of Income Tax (Appeals), NFAC, Delhi [“CIT(A)/NFAC”], u/s. 250 of the Income Tax Act, 1961 (the “Act”), pertaining to Assessment Year (“AY”) 2019-20 whereby he has confirmed the penalty of Rs. 10,000/- u/s. 272A(1)(d) of the Act levied by the Ld. Assessing Officer (“AO”).

2.

Briefly stated, the facts of the case are that the assessee is an individual. For AY. 2019-20, she did not file return of income as her income was below taxable limit. During the relevant AY. the assessee was working in Bank Mitra Scheme on behalf of Bank of India and acting as an agent and entitled for commission. The activity facilitated the customers of Bank of India by use of the outlet of the assessee to carry out banking functions such as deposits/withdrawals of cash etc. For this activity, the assessee was entitled for commission from bank. For this, the assessee

2 opened a bank account in Bank of India, through which activities were carried out. As per the information available from ITBA Portal that there were large cash deposits in assessee‟s bank account, the reassessment proceedings were initiated by issuance of notice u/s. 148 of the Act on 09- 03-2023, but the assessee failed to respond. Thereafter, statutory notice u/s. 142(1) of the Act was issued and served upon the assessee on 09-10- 2023 calling for certain details/documents/explanation. However, the assessee did not comply with the notice. Due to the lack of any response from the side of the assessee, the Ld.AO treated the entire cash deposits as income of the assessee by invoking provisions of section 69A of the Act and made an addition of Rs. 1,80,64,269/- vide order dt. 09-02-2024 passed u/s 144 r.w.s. 147 of the Act. Subsequently, the Ld. AO initiated penalty proceedings u/s 272A(1)(d) for non-compliance of the notice u/s. 142(1) of the Act, dt. 09-10-2023 and levied penalty of Rs. 10,000/-, on the assessee vide his order dt. 23-07-2024 u/s. 272A(1)(d) of the Act.

3.

Aggrieved, the assessee preferred an appeal before the Ld.CIT(A)/NFAC with a delay in filing of the appeal. The Ld.CIT(A)/NFAC though condoned the delay, dismissed the appeal of the assessee and confirmed the penalty of Rs. 10,000/- imposed by the Ld.AO u/s. 271A(1)(d) of the Act, observing as under:

“5.2 I have considered the facts of the case and grounds of appeals, gone through the penalty order and the submission of the appellant. The appellant filed an appeal against the order passed by the AO imposing penalty u/s 272A(1)(d) of the Act amounting to Rs. 10,000/- for non- compliance to notice u/s 142(1) of the Act.

5.

3 During the penalty proceedings, the AO has observed that the penalty proceedings u/s 272A(1)(d) of the Act was initiated for the reason that the appellant had not complied with the statutory notice u/s 142(1) of the Act dated 09.10.2023 issued during the course of assessment proceedings. The appellant did not make compliance to any of the show cause notices issued during the penalty proceedings. Therefore, the AO held that since the appellant had failed to comply with the statutory notices, the case was fit for levying penalty u/s 272A(1)(d) of the Act. Accordingly, the AO levied penalty amounting to Rs. 10,000/- u/s 272A(1)(d) of the Act.

5.

4 During the appellate proceedings, the appellant submitted that she had limited knowledge and remained completely unaware of the notices issued in connection to the reassessment proceedings. However, the appellant's claim of lack of knowledge of the ongoing proceedings is not acceptable as whenever notices are being issued, a message is prompted to the registered mobile number and email sent to the registered email id regarding the notice being issued.

5.

5 On the proper appreciation and evaluation of the order passed by the AO and reply of the appellant, it is observed that the AO had levied penalty u/s 272A(1) (d) of the Act for non-compliance to notice u/s 142(1) of the Act dated 09.10.2023 issued during the course of assessment proceedings. The appellant had not submitted any valid explanation or reason for such non-compliance. The appellant has not been able to put forth any justification for non levy of penalty. It is also seen that the assessment in this case was completed ex parte u/s 144 of the Act and even the initial non-compliance by the appellant was not made good subsequently by the appellant. In view of the above facts, I hold that since the appellant has failed to show any reasonable cause for coming within the purview of 273B of the Act, the imposition of penalty by the AO amounting to Rs. 10,000/- is upheld. The ground of appeal is, therefore, dismissed.”

4.

Dissatisfied by such order of the Ld.CIT(A)/NFAC, the assessee is in appeal before the Tribunal raising the following solitary ground of appeal:

“1. On the facts and in the circumstances of the case and in law, Ld. AO erred in levying the penalty of Rs. 10,000/- u/s 272A(1)(d), without appreciating the fact of the case, your appellant prays for deletion of entire penalty. Your appellant prays for deletion of entire addition. Your appellant craves for to add, alter amend, modify, delete any or all grounds of appeal before or during the course of hearing in the interest of principle of natural justice.”

5.

The Ld.AR submitted that non-compliance to the notice issued by the Ld.AO u/s. 142(1) of the Act, dt. 09-10-2023 was not intentional. Reiterating the reasons stated before the Ld.CIT(A)/NFAC for the said non compliance, the Ld.AR submitted that the assessee is a person of very limited means and knowledge and her income is below the taxable limit. She had not accessed the income tax e-portal and was completely unaware of the various notices issued to her in connection with the re-assessment proceedings. The assessee was also not aware about the passing of the assessment order and came to know about the same only when the penalty order was passed and the assessee started receiving calls for recovery of demand. Soon thereafter, she filed the appeal before the 4 Ld.CIT(A)/NFAC. He submitted that the Ld.AO has failed to appreciate the facts of the case in the correct perspective, and therefore, urged that the penalty levied by the Ld.AO and confirmed by the Ld.CIT(A)/NFAC be deleted.

6.

The Ld.DR, on the other hand, supported the order of the Ld.CIT(A)/NFAC and submitted that since the assessee failed to make any compliance to the various notices issued by the Ld.AO both during the assessment and penalty proceedings including the impugned notice u/s. 142(1) of the Act, the Ld.CIT(A)/NFAC was completely justified in dismissing the appeal of the assessee while confirming the penalty levied by the Ld.AO.

7.

We have heard the Ld. Representatives of the Parties and perused the material available on record. We find that the Ld.AO initiated penalty proceedings u/s. 271A(1)(d) of the Act for the reason that the assessee failed to comply with the notice u/s. 142(1) of the Act, dt.09-10-2023 issued during the course of assessment proceedings. Before us, the Ld.Counsel for the assessee has submitted that non-compliance to the said notice was not deliberate, but resulted due to the reasons stated above. He has therefore, prayed that since the assessee had bonafide reasons/explanation for non-compliance to the notice issued by the Ld.AO, therefore, the penalty imposed by him and confirmed by the Ld.CIT(A)/NFAC should be deleted. We find that the Ld.CIT(A)/NFAC has confirmed the penalty imposed by the Ld.AO for the reasons which we have already reproduced in the preceding paragraphs. Admittedly, there was non-compliance to the notice issued u/s. 142 of the Act, dt. 09-10- 2023 pursuant to which, the Ld.AO has levied penalty of Rs. 10,000/- for the said non-compliance u/s. 271A(1)(d) of the Act. However, we find some force in the arguments advanced by the Ld.Counsel for the assessee

5 that there was no deliberate intention on the part of the assessee and she failed to comply with the impugned notice for a reasonable cause. We, therefore, set aside the order of the Ld.CIT(A)/NFAC and direct the Ld.AO to delete the penalty of Rs. 10,000/- imposed u/s. 271A(1)(d) of the Act. Accordingly, solitary ground raised by the assessee is allowed.

8.

In the result, the appeal of the assessee is allowed.
