आदेश / ORDER
PER SHRI SANDEEP GOSAIN, JUDICIAL MEMBER:
These appeals and cross-objections have been filed by the Revenue and the assessee against the order of the Commissioner of Income Tax (Appeals) dated 27-Feb-2026 for the Assessment Years 2008-09 and 2007- 08.
Since the issues involved in these appeals and cross-objections are identical and pertain to the same assessee, they have been clubbed together, heard together, and are being disposed of by this consolidated order. Firstly, we shall take up ITA No. 2391/MUM/2026 for A.Y. 2008-09. The Revenue has raised the following grounds of appeal:
"Whether on the facts and circumstances of the case and in law, the Ld. CIT(A) erred in the not appreciating the fact that the assessment proceedings are re-opened u/s 148 on the basis of an information from the Investigation Wing-Mumbai in case of Shri Bhawarlal Jain, a hawala entry operator."
"Whether on the facts and in the circumstances of the case and in law, the CIT(A) has erred in deleting the addition of Rs.4,49,000/- made by the AO on account of bogus loan, ignoring the fact that the addition was made based on credible information received from the DGIT(Inv.) Mumbai?"
"Whether on the facts and in the circumstances of the case and in law, the CIT(A) while deciding the issue has ignored the fact that action of the AO was based on the information/Report received from the DGIT (Investigation Wing), Mumbal about the hawala traders were indulged only in providing accommodation entries in the form of issuing bogus Sales/Purchase bills without supplying any goods and the assessee was found to be one of the beneficiaries, who had obtained accommodation entries for bogus loans amounting Rs. 4,49,000/- from M/s. Chandra Impex, and thereby to suppress it's true profit."
"Whether on the facts and circumstances of the case and in law, the Ld. CIT(A) has ignored the fact that M/s Chandra Impex is a partnership firm, in which Mr. Manish B. Jain(Husband of appellant) and Bhanwarlal M. Jain (Father-in-Law of the appellant) are the partners."
"Whether on the facts and circumstances of the case and in laus, the Ld. CIT(A) erred not appreciating that the burden of proof was on the assessee to prove the genuineness of the transactions."
"Whether on the facts and in the circumstances of the case and in law, the Ld CIT(A) has ignored that though there was no dispute that the bogus loans transactions were accounted and so act of infraction of law was committed in violation of section 74(1A) of the Maharashtra Value Added Tax Act, 2022 and therefore such expenses is not allowed as per express provisions u/s. 37 of the Act.
"Whether on the facts and in the circumstances of the case and in law, the Ld. CIT(A) has failed to appreciate the decision of the of the Hon'ble Supreme Court in the case of M/s. N. K. Proteins Ltd. Vs. Dy. CIT (2016) 292 CTR (Gul) 354, Dated. 16.01.2017, wherein Hon'ble Supreme Court has dismissed the appeal and held that once a findings of act has been given that entire purchases/loans shown on the basis of fictitious invoices and debited in the P & L account are established as bogus, then restricting the addition to a curtained percentage goes against the principles of section 68 and 690 of the Income-Tax Act, 1961 and when the transactions are from bogus suppliers or concerns, the entire purchases/loans are Hable to disallowed?"
"Whether on the facts and in the circumstances of the case and in law, the decision in the case of M/s. Swetamber Steels Ltd. (Supra), the Hon'ble ITAT, Ahmadabad, has been ignored by the Ld. CIT (A), which had conformed the disallowance of the bogus purchases/loans, by stating that the transactions shown from respective parties were found non- genuine and the decision of the ITAT was upheld by Hon'ble Gujrat High Court and also by the Hon'ble Supreme Court."
"The appellant craves to add, alter, classify, reclassify, delete or modify any of the above grounds of appeal and requests to consider each of the above grounds without prejudice to one another.""
All the grounds raised by the Revenue are interrelated and interconnected and relate to challenging the order of the Ld. CIT(A) in deleting the additions made by the AO on account of bogus loans. Therefore, I have decided to adjudicate these grounds through the present consolidated order.
I heard the counsel for both the parties, perused the material placed on record, the judgments cited before me, and the orders passed by the Revenue Authorities. From the records, I notice that the only issue involved in the present case is that the AO made an addition of Rs. 4,49,000/- being an unsecured loan taken from M/s. Chandra Impex, an entity run by Bhanwarlal Jain and his sons, treating the same as an accommodation entry. Identical additions were also made in different assessment years.
More particularly, the Ld. CIT(A), in the assessee's own case for A.Y. 2009-10, had deleted the identical addition under identical facts, which was also made on account of the loan taken from M/s. Chandra Impex, an entity run by Bhanwarlal Jain and his sons, treating the same as an accommodation entry. Apart from this, the Coordinate Bench of the ITAT in the following cases:
(i) ACIT-18(3), Mumbai vs. Rajesh Hastimal Kachhara in ITA No. 2583/Mum/2016 dated 26.04.2017 for A.Y. 2007-08;
(ii) ITO-32(1)(5), Mumbai vs. Gujarat Construction in ITA No. 7040/Mum/2016 dated 24.05.2017 for A.Y. 2007-08; and (iii) ITO-25(3)(5), Mumbai vs. Vikram Muktilal Vora in ITA No. 842/Mum/2017 dated 23.05.2017 for A.Y. 2007-08,
had already deleted identical additions under identical facts. Therefore, while deleting the addition in the present case, the Ld. CIT(A) rightly relied upon the decision in the assessee's own case for A.Y. 2009-10 as well as the decisions of the Coordinate Bench of the ITAT discussed above.
The Ld. DR, appearing on behalf of the Revenue, could not distinguish the facts of the present case from those of the cases already decided by the Coordinate Bench of the ITAT and the assessee's own case for A.Y. 2009- 10. Moreover, nothing has been placed on record to controvert or rebut the findings recorded by the Ld. CIT(A) for A.Y. 2009-10, which are equally applicable to the present assessment year.
Therefore, I see no reason to interfere with or depart from the well- reasoned findings recorded by the Ld. CIT(A). Accordingly, the grounds raised by the Revenue stand dismissed.
Accordingly, the appeal of the Revenue stands dismissed.
ITA No. 2383/Mum/2026 (A.Y. 2007-08)
Since the facts of the case in ITA No. 2383/Mum/2026 for A.Y. 2007- 08 are similar to those in ITA No. 2391/Mum/2026 for A.Y. 2008-09, the findings and decision rendered in the above paragraphs shall apply mutatis mutandis to this appeal also.
CO Nos. 208 & 207/Mum/2026
Since I have already dismissed the appeals filed by the Revenue, the Cross Objections filed by the assessee have become infructuous and, therefore, require no adjudication.
In result appeal filed by the Revenue and the Cos filed by the assessee stands dismissed.
Order pronounced in the open court on 28.07.2026.
