सुनवाई की तारीख / Date of conclusion of hearing: 18.05.2026 घोषणा की तारीख / Date of pronouncement: 04.08.2026 आदेश / ORDER PER GIRISH AGRAWAL, ACCOUNTANT MEMBER: This appeal is filed by the assessee against the order of ld. CIT(A)/National Faceless Appeal Centre vide DIN: ITBA/NFAC/S/250/2025-26/1083480663(1) dated 09.12.2025 passed against the assessment order by the National Faceless Assessment Centre Delhi, u/s 147 r.w.s. 144 r.w.s. 144B of the Income-tax Act (hereinafter referred to as the “Act”), dated 28.03.2022, for the Assessment Year 2016-17.
Assessee has raised the following grounds of appeal: 1) Ground No. 1 - On the facts and circumstances of the case and in law, the ITO Ward, 20(1)(1), Mumbai has erred in passing the order u/s. 148A(d) and also issuing the notice u/s. 148 without appreciating that he was not having the jurisdiction for the same in view of Section 151A and the notification issued thereunder notifying e-Assessment of Income Escaping Assessment Scheme, 2022 and, thereby, rendering the said order and the notice as well as the entire assessment proceeding as null and void. 2) Ground No. 2 - On the facts and circumstances of the case and in law, the reopening of the assessment under section 147 of the Act is bad in law in so far as there was no fresh tangible material available with the Ld. Assessing Officer and that the assessment has been reopened merely on the basis of change of opinion. 3) Ground No. 3 - On the facts and circumstances of the case and in law, the appeal of the assessee before the CIT (A) may please be restored back and the non-compliance of the assessee in respect of the notices issued by the Ld. CIT (A) may please be excused as it was for the genuine reasons. 4) Ground No. 4 - On the facts and circumstances of the case and in law, the Ld. CIT(A) erred in confirming the action of the Ld. Assessing Officer in disallowing freight expenses under section 40(a)(ia) amounting to Rs 46,32,240.
At the outset, we refer to ground no. 3 raised by the assessee as noted above, whereby assessee seeks restoration of the matter back to the file of ld. CIT(A) on account of non-compliance by him for the notices issued at the first appellate stage. Assessee has furnished a notarized affidavit, dated 15.05.2026 explaining the reasons for non-compliances to the notices issued for hearings fixed by ld. CIT(A)/NFAC. Contents of the same are extracted below for ready reference: “1. That the order under section 250 of the Act has been passed by the Ld. CIT(A) /NFAC on 09-12-2025. 2. That I could not make timely compliances to the notices of hearing issued by the Ld. CIT(A)/NFAC.
That I had shifted my godown w.e.f. 01-07-2021 to Gala No 4,5 and 6 First Floor, Survey no 22/3, RCC Building no A2, Gayatri Compound, Bhiwandi, Thane - 421302. 4. That I further state that I have discontinued by business operations from the year 2022. The status of my GST Registration being cancelled is attached. 5. That since the matter pertains to a very earlier year and that owing to the reasons as stated above, I was finding it difficult to locate the relevant documents to be furnished before the Ld. CIT(A)/NFAC. 6. That I further state I was already being assessed under section 143(3) vide order dated 30-12-2018. 7. That during the regular assessment proceeding I was required to furnish the details pertaining to freight charges aggregating to Rs 1.54cr. 8. That the reassessment proceeding was initiated for verifying the TDS deducted on the aforesaid freight and ultimately disallowance under section 40(a)(ia) was confirmed. That I was even finding it difficult for locating the documents which were submitted during the regular assessment proceeding due to the reasons as stated above.”
From the perusal of the impugned assessment order, it is noted that assessee did not furnish any submissions nor sought any adjournments for the statutory notices issued by the ld. Assessing Officer on several occasions u/s. 142(1). A partial submission was made in response to one of the show cause notices whereby assessee filed a purchase agreement for the flat showing consideration of Rs. 12,50,000/- and certificate of importer/exporter.
4.1. Case of the assessee is that he filed his original return on 16.10.2016, reporting total income at Rs.4,00,860/-. Assessment was completed u/s. 143(3) vide order dated 30.12.2013 with total income assessed at Rs.18,04,290/-, after making addition of Rs. 1,00,000/- on account of sundry expenses and Rs.13,03,430/- towards long term capital gain. Subsequently, it came to the knowledge of the ld. Assessing Officer that assessee has claimed Rs.1,54,40,800/- as freight expenses on which TDS is not done, leading to escapement of income for which re-opening proceedings were initiated by issuing notice u/s. 148 dated 30.03.2021. In the re-assessment proceedings, ld. Assessing Officer disallowed freight expenses to the extent of 30% for not doing TDS and made the addition of Rs.46,32,240/-.
4.2. In the first appeal, ld. CIT(A) issued several notices fixing the date of hearing, however, there was no response from the assessee except for seeking adjournments. Details in this regard is tabulated below: SI. No. Hearing Notice Date of Date of response issued on compliance 1 08/08/2023 15/08/2023 15/08/2023 sought adjournment 2 10/04/2024 16/04/2024 No response
3 17/04/2024 23/04/2024 29/04/2024 sought adjournment 4 25/06/2025 02/07/2025 02/07/2025 sought adjournment 5 21/11/2025 28/1 1/2025 No response
4.3. According to the ld. CIT(A), all the notices were sent to the email ID as provided by the assessee but there was no response. Ld. CIT(A), thus observed that assessee has not discharged his burden. He has not availed the several opportunities provided to him. He thus, proceeded to dispose of the appeal on merits after considering the statement of facts and other material available on record. Based on the conduct of the assessee, he sustained the addition made by the ld. Assessing Officer and dismissed the appeal, against which he is in appeal before the Tribunal.
In the given set of facts and considering the submissions made by the assessee through his affidavit explaining the reasons for non- compliance at the first appellate stage, in the interest of justice and fair play, we find it appropriate to remit the matter back to the file of ld. CIT(A) for de novo meritorious adjudication of the grounds raised by the assessee at the first appellate stage. Needless to say, assessee be given reasonable opportunity of being heard and to make all relevant submissions as required to substantiate the claim made by him. We also direct the assessee to be diligent in making all his submissions, so as to comply with the notices for hearing for effective and expeditious disposal of the first appeal proceedings. Accordingly, the impugned order passed by the ld. CIT(A) is set aside. Grounds raised by the assessee are allowed for statistical purposes.
In the result, appeal of the assessee is allowed for statistical purpose.
