Jagadish Naskar Vs. ITO, Ward-43(1), Kolkata Gopalpur Bandal Sarkar Pool, Maheshtala, South 24 Parganas West Bengal-743357 [PAN: AKYPN3260H] APPELLANT RESPONDENT Appellant by : Shri Amit Agarwal, AR Respondent by : Shri Ambrish Mishra, DR Date of hearing : 03.08.2026 Date of Pronouncement : 05.08.2026 O R D E R PER GOPALAN GURUSAMY, ACCOUNTANT MEMBER: This Appeal is filed by the Assessee against the order of the NFAC, Delhi (‘Ld. CIT(A)’ for short) dated 16.04.2026, passed u/s 250 of the Income Tax Act, 1961 (“the Act”, for short) for the Assessment Year 2020-21.

2.

The brief facts on record are that, the Assessing Officer initiated proceedings u/s 147 of the Act based on certain information under RMS. The crux of the information was that the assessee had entered into certain property transactions, in respect of which income was not disclosed to the department. In response to the notice u/s 148 of the Act, the assessee had filed return of income declaring a total income of

ITA No.2003/KOL/2026 Jagadish Naskar; A.Y: 2020-21 Rs.4,20,510/-. The Assessing Officer called upon the assessee to explain the gain the derived from sale of certain items of property, referred in the information flagged, the proportionate share of the assessee aggregating to Rs.42,54,184/-. No response was filed to the show cause notice issued by the Assessing Officer. Hence, the Assessing Officer added an amount of Rs.42,54,184/- to the total income vide the assessment order dated 12.03.2025.

3.

Aggrieved, the assessee preferred appeal before the Ld. CIT(A), with a delay of 167 days. The Ld. CIT(A) found that the assessee had not shown sufficient cause for the delay and concluded that the delay does not merit condonation and hence dismissed the appeal.

4.

Before us, the Ld. AR represented that the delay in filing the appeal before the Ld. CIT(A) was due to the health reasons of the assessee, and that the Ld. CIT(A) erred in not condoning the delay and in confirming the addition of a hypothetical amount. It was contended that duplicate entries of the same transaction have been considered in making the hypothetical addition. Hence, it was pleaded that the matter may be set aside to the Assessing Officer. However, the Ld. DR relied on the order of the Ld. CIT(A).

5.

We have considered the submissions and also perused the details on record. We note that the assessee’s contentions have not

ITA No.2003/KOL/2026 Jagadish Naskar; A.Y: 2020-21 been properly considered. In the interest of justice, we condone the delay in filing the appeal before the CIT (A) and restore the matter to the Assessing Officer to decide the issues afresh after giving adequate opportunity to the assessee.
