“1. The appeal Order dated 14.09.2024 is bad in law. 2. The appeal order dated 14.09.2024 is not based on facts of the case. 3. Unfortunately, the assessee did not receive any notice relating to the assessment proceedings or appeal proceeding either through email or through Post at the registered address of assessee. Assessee deserve adequate opportunity to explain its case before the officer. 4. The assessee missed to make use of the opportunity the Ld. Appeal Authority wanted to grant. 5. The order of the officer is based on non-representation/non reply and is nto based on demerits of the case. 6. The results of the said order in Appeal are harsh on assessee and justice will be served if another opportunity is given to present facts before the Officer. 7. It would not be one sided benefit to the Revenue if the opportunity is granted to the Assessee to be heard again. The assessee is confident to prove the additions under section 68 as incorrect.” 4. At the time of hearing, non-appeared on behalf of the assessee.
Ld. Departmental Representative submitted that the assessee had not filed application for condonation of delay of 639 days in filing the appeal before Ld. CIT(A).
From examination of record in light of the aforesaid rival contention, it is crystal clear that Ld. CIT(A) vide order dated 14.09.2024 dismissed the appeal of assessee being barred by limitation, since, the assessee had not filed any application for condonation of delay of 639 days in filing the appeal. In the present appeal, there is delay of 639 days in filing appeal due to non-receipt of communication, improper advice due to change in rules of law and recipient reply not forwarding notices to the management.
