Appeal in this case has been filed by the assessee against the order dated 25.03.2026 passed by the CIT(A)/NFAC, Delhi for the A.Y. 2018-19. Grounds of appeal are as under :-
“1. On the facts and in the circumstances of the case and in law, the order dated March 25, 2026 passed under section 250 by the Learned Additional/Joint Commissioner of Income-tax (Appeals), Panaji ['Ld. CIT(A)'], upholding the intimation dated June 13, 2019 issued by the Central Processing Centre ('CPC) under section 143(1) of the Act, is erroneous, unjustified and bad in law. 2. On the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in passing the order dated March 25, 2026 in the name and PAN of a non-existent entity, Boston Scientific Services Private Limited, which had ceased to exist pursuant to its merger with BSTESPL with effect from April 1, 2020, and the impugned order is therefore void ab initio and liable to be quashed. 3. On the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in confirming the disallowance of the net gratuity provision of INR 54,42,445 under section 43B of the Act without appreciating that the Appellant had already Suo-moto disallowed the said amount under section 40A(7) of the Act in line item 9(c) of 'Part AOI' in the ROI, thereby resulting in a clear case of impermissible double disallowance. 3.1. That the Ld. CIT(A) failed to appreciate that the tax auditor had inadvertently reported the same provision for gratuity twice in the TAR, once under clause 21(e) (related to Section 40A(7)] and again under clause 26(1)(b)(a) [related to Section 43B], despite the fact total amount of gross provision of gratuity debited to profit & loss account was only INR 57,17,776.

On the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in upholding the disallowance of gratuity amounting to INR 2,75,331, without appreciating that the amount represents actual amount paid by the appellant and quantify by the Tax Auditor in Tax Audit report
On the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in not deleting the consequential levy of interest under section 234B and section 234C of the Act.”
