Whether the addition on account of unexplained cash investment was justified when the assessee claimed the transaction was through banking channels, and if the CIT(A) erred in deleting the addition based on prior ITAT decisions.

PER SHRI SANDEEP GOSAIN, JUDICIAL MEMBER:

ITA No. 6972/MUM/2026

This appeal is filed by the Department against the order of the Ld. NFAC, Delhi, dated 18.03.2026 for the Assessment Year 2011-12. The Department has raised the following grounds:

1.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in deleting the addition of ₹6,80,00,000/- made u/s 69 of the Income-tax Act, 1961 on account of unexplained cash investment/on-money payment in purchase of flat in "One Avighna Park" project of M/s Nish Developers Pvt. Ltd."

2.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in holding that the addition was made merely on the basis of information received from the Directorate of Investigation, without appreciating that the information was based on search-derived material, seized pen-drive/records, statements of key persons of the builder group, and assessee-specific details linking the assessee with cash payment."

3.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in treating non-grant of cross-examination as fatal to the addition, without appreciating that the addition was not based solely on oral statements but on documentary/search-derived material corroborated by statements and surrounding circumstances."

4.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in holding that no independent enquiry was conducted by the AO, without appreciating that the AO had confronted the assessee with the information, considered the assessee's reply, examined the material received from the Directorate of Investigation, and obtained clarification regarding the amount relatable to the assessee."

5.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in accepting the assessee's mere denial of cash payment as sufficient rebuttal, without appreciating that once specific material indicated unrecorded investment, the onus was on the assessee to explain the nature and source of such investment to the satisfaction of the AO as required u/s 69."

6.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) erred in relying upon stamp duty/market value of the property to hold that cash payment was improbable, without appreciating that stamp duty valuation is not conclusive proof of absence of on-money and cannot override specific search derived material indicating cash payment."

7.

"Whether, on the facts and in the circumstances of the case and in law, the Ld. CIF(A) erred in mechanically relying upon decisions in other cases involving M Nish Developers Pvt. Ltd. without independently appreciating the assessee-specific seized material, amount- specific information and facts of the present case."

8.

"The appellant craves leave to add, amend, alter or withdraw any of the above grounds at the time of hearing."

2.

We have heard the counsel for the parties, perused the material placed on record, the judgments cited before us, and the orders passed by the Revenue authorities. From the records, we notice that, as per the facts of the present case, the assessee had filed its return of income, which was processed under section 143(1) of the Income-tax Act. However, a search and seizure action was conducted in the case of M/s Nish Developers Private Limited and group cases. During the said search operation, it was revealed that a cash amount of Rs. 7.30 crore, being Rs. 6.80 crore pertaining to AY 2011-12 and Rs. 50 lakh pertaining to AY 2012-13, in the name of the assessee, namely, Mukesh J. Mehta, for the purchase of a flat in Project "Avigna Park", had been paid in cash. Consequently, additions were made in the hands of the assessee.

3.

On the contrary, from the very beginning, the assessee had taken a specific stand and explained that he had not made any such cash payment to the said builder for the purchase of the flat and that the entire transaction for the purchase of the flat had been made through proper banking channels. However, while relying upon the statements recorded during the course of the search action, additions were made in the hands of the assessee. On appeal, the Ld. CIT(A) deleted the said additions while relying upon the decision of the Coordinate Bench of the ITAT on a similar set of facts. The operative portion of the order of the Ld. CIT(A) is contained in para 4 and the same is reproduced herein below:

4.

After considering the facts of the present case, hearing the parties at length, and perusing the records, we notice that the Coordinate Bench of the ITAT has already deleted the additions in the cases of the respective assessees on an identical set of facts, and the details thereof are mentioned in the order of the Ld. CIT(A). Since the Ld. CIT(A) has taken the decision by following the decisions of the Coordinate Benches of the ITAT on similar facts involving M/s Nish Developers Private Limited with respect to the same issue, and moreover, no new facts or circumstances have been brought before us by the Ld. DR to controvert or rebut the findings recorded by the Ld. CIT(A), we find no reason to interfere with the said findings.

5.

Accordingly, we dismiss the grounds raised by the Revenue and uphold the order passed by the Ld. CIT(A).

6.

In the result appeal filed by the Revenue stands dismissed.

ITA 3294/MUM/2026

7.

8.

Since the facts in this appeal are similar to those in ITA No. 6972/MUM/2026, the findings and decisions rendered in the above paragraph shall apply mutatis mutandis to this appeal also.

9.

Accordingly grounds raised by the assessee stands allowed.
