For Appellant: Shri Jayesh Gandhi for Shri MS Chhajed, AR
For Respondent: Shri Deependra Kumar, Sr. DR
Hearing: 13.07.2026Pronounced: 11.08.2026

PER DR. B.R.R. KUMAR, VICE-PRESIDENT:

- The captioned appeal has been filed by the assessee against the order passed by the Ld. Commissioner of Income Tax (Appeals) (in short “Ld. CIT(A)”), Jaipur-5 vide order dated 21.10.2025 relevant to Assessment Year 2013-14. 2. At the outset, the Ld. Counsel for the assessee submitted that the Ld. CIT(A) has passed order without adjudicating the grounds raised and pleaded that given an opportunities due submission would be made before the Ld. CIT(A) on merits as well as on technicalities. Asst. Year : 2013-14 - 2–

3.

We have heard the rival submissions and perused the material available on record. We find that the assessee has challenged both the validity of reopening of assessment and the additions/disallowances made by the Assessing Officer. The assessee has also raised specific grounds regarding the applicability of the proviso to section 147, change of opinion, approval for reopening, excise duty provision, MAT credit and non-grant of TDS credit.

4.

We find Ld. CIT(A), who dismissed the appeal of the assessee by observing as follows:

“…After considering the submissions of the appellant, perusal of the records, and hearing the Revenue's arguments, this tribunal finds no merit in the appellant's grounds challenging the validity of the assessment order passed under section 147 read with 144B of the Act. and substantive The procedural approvals, timelines for response, additions/disallowances made by the AO are in conformity with statutory provisions and settled judicial precedents. Accordingly, the appeal filed by the appellant is dismissed and the assessment order dated 22.09.2021 passed by the Assessing Officer stands upheld. Following the above discussion, I uphold the additions made by the AO. Thus, grounds of appeal 1 to 10 are hereby dismissed…”

5.

From the impugned appellate order, it is found that the issues raised by the assessee have not been adjudicated in a comprehensive and reasoned manner. In particular, the grounds relating to the validity of reopening, the applicability of the proviso to section 147 of the Act, Asst. Year : 2013-14 - 3– the alleged change of opinion, the objections raised by the assessee, and the validity of the approval granted by the competent authority require proper examination on the basis of the assessment records and the material available on record.

6.

In the interest of justice, we deem it appropriate to restore the matter to his file of Ld. CIT(A) for fresh adjudication of all the grounds raised by the assessee, in accordance with law, after providing reasonable opportunity of being heard to the assessee. The assessee is directed to submit all relevant bank statements, documents and explanations before the Ld. CIT(A) and to strictly comply with the notices issued by the revenue authorities without seeking any unnecessary adjournments.

7.

In the result, the appeal filed by the assessee is allowed for statistical purposes.

The order is pronounced in the open Court on 11.08.2026. (RAHUL CHAUDHARY) VICE-PRESIDENT () () Ahmedabad; Dated 11.08.2026 MV Asst. Year : 2013-14 - 4–
