SOCIETY FOR WELFARE OF THE HANDICAPPED PERSONS,DURGAPUR vs. I.T.O., WARD - 2(1), EXEMPTION, DURGAPUR
What did the Tribunal hold?
The Tribunal held that disallowing the entire expenditure under Section 143(1) was not a prima facie adjustment. Even if exemption under Section 11 was not allowable, income should have been computed on commercial principles after considering the claimed expenses.
What were the facts?
The assessee, a charitable institution, filed its income tax returns claiming expenses. The CPC processed the return under Section 143(1) and disallowed the entire expenditure due to procedural and technical lapses in filing the audit report (Form 10B) with the return. The CIT(A) upheld this disallowance.
What were the issues?
Whether the disallowance of entire expenditure under Section 143(1) for procedural lapses is valid, and whether income should be computed on commercial principles.
Which sections of the Income-tax Act were involved?
