ITA No.747/Chny/2026 (2016-17) Dhanasekaran Sengodan this penalty order, preferred an appeal before the Ld. CIT (A), who in turn partly allowed the appeal and amount of penalty was reduced to Rs. 10,000/- from earlier amount of Rs. 20, 000/-. The assessee being further aggrieved preferred the present appeal before us.
We have gone through the assessment order passed u/s. 147 r.w.s. 144 of the Act, penalty order passed u/s. 271(1) (b) of the Act, order of the Ld. CIT (A) and submissions of the assessee along with grounds taken before us. It is observed that the assessee was a resident of the USA during the proceedings period and due to this reason, he could not gather the details or respond during the assessment proceedings. The AO enforced the penalty because nothing was there on record before him but the Ld. CIT (A) has gone through the facts of the case prudently and in a justifiable manner and applied the law that the penalty u/s. 271(1) (b) of the Act cannot be enforced for each and every notice issued. It was also observed by the Ld. CIT (A) that the assessee has afford an explanation, supported by documents and has made subsequently compliance during penalty stage. In view of this he restricted penalty upto to Rs. 10, 000/- only.
In the penalty proceedings, the assessee submitted the following documents as required by the AO as under:-
Copy of the reply dated 30.01.2024 to the earlier penalty notice issued under section 271 (1) (b). 2. Copy of the VISA is enclosed to confirm the assessee was not staying in India. 3. Copy of the Form 35 is enclosed. 4. Copy of the Appeal filed ARN is enclosed. 6. We have thoroughly considered the facts of the case and law applicable. It is observed that non-compliance by the assessee u/s. 142(1) of the Act was not willful and the same was not detrimental to the interest of the Revenue as there was no income in the hands of the assessee which is chargeable to tax in India at that time. In view of this, the balance amount of penalty i.e. Rs. 10,000/- is also deleted considering our observations and facts of the case enumerated (supra). The
