PER SHRI RAJPAL YADAV, JUDICIAL MEMBER : The Assessee is in appeal before the Tribunal against the order of Ld.Commissioner of Income Tax(Exemptions), Ahmedabad [‘Ld.CIT(E)’ in short] dated 29/12/2017 passed u/s.80G(5) of the Income Tax Act, 1961 (hereinafter referred to as ‘the Act’).
The assessee has filed an application in Form No.10G on 08/06/2017 for grant of registration u/s.80G(5) of the Act. Since it failed
ITA No.515/Ahd/2018 Shashvat Anand Aaradhana Trust vs.CIT(E) - 2 - to submit complete details, this application was rejected by the Ld.CIT(E) vide order dated 29/12/2017.
Dissatisfied with this rejection, assessee has come up by way of this appeal. 4. The ld.counsel for the assessee submitted that during the pendency of this appeal, assessee has filed a fresh application along with requisite documents and that application stands allowed. Assessee has been granted registration vide order 29/11/2018, copy of this order has been placed on the record.
In view of the subsequent development, assessee does not want to pursue the present appeal and prayed that same be dismissed as withdrawn. Since assessee has been withdrawing its appeal, therefore we do not have any objection on such request. The appeal is dismissed as withdrawn.
In the result, appeal of the assessee is dismissed as withdrawn. Order pronounced in the Court on 6th June-2019 at Ahmedabad.
