PER: SANDEEP GOSAIN, J.M. This appeal has been filed by the assessee against the order of the ld. CIT(A)-1, Jaipur dated 13/12/2019 for the A.Y. 2010-11. 2. The hearing of the appeal was concluded through video conference in view of the prevailing situation of Covid-19 Pandemic.
The ld. Counsel for the assessee furnished an application for withdrawal of this appeal. The contention in the said application reads as under:
2 ITA 126/JP/2020_ M/s Anjana Real Estate P Ltd. Vs ITO “The assessee has filed an application under Vivad Se Vishwas Scheme on 29/05/2020 vide Acknowledgement No. 342195911290520. The Form No. 3 has been issued by designated authority u/s 5(1) Direct Tax Vivad Se Vishwas Act 2020 vide acknowledgement No. 114576050060121 dated 06/01/2021. We hereby withdraw the appeal paying tax on the disputed income. Thanking you For Anjana real Estate Pvt. Ltd. Rohit Agarwal (Director)”
The ld DR has raised no objection if the appeal of the assessee is allowed to be withdrawn.
Therefore, in view of the fact that the assessee has already approached the department to settle the matter under Vivad Se Vishwas scheme, we permit the assessee to withdraw its appeal. Accordingly, the appeal of the assessee is dismissed as withdrawn.
