We have considered the rival submissions. In the instant case, the tax effect for the assessment year 2014-15 is Rs.20,17,881/- and for the assessment year 2016-17 is Rs.12,32,868/-. According to recent CBDT Instruction No.09/2024 dated 17th September, 2024, the revenue should not challenge the order of the ld CIT(A)’s order before the Tribunal if the tax effect due to relief granted is less than Rs.60,00,000/- unless the case falls within the exceptions.
