At the time of hearing, none appeared for assessee. However, upon perusal of impugned order, it could be seen that impugned order is an ex-parte order. The Ld. Sr. DR pleaded for dismissal of the appeal. We find that in the assessment order, the assessee has been saddled with addition of Rs.9.57 Lacs. The Ld. CIT(A) confirmed the same since the assessee failed to make any representation during appellate proceedings. Aggrieved, the assessee is in further appeal before us.
Keeping in mind the principle of natural justice, the bench deems it fit to grant another opportunity of hearing to the assessee. Accordingly, the impugned order is set aside and the appeal is restored back to the file of Ld. CIT(A) for de novo adjudication on merits after affording opportunity of hearing to the assessee. The assessee is directed to substantiate its case.
The appeal stand allowed for statistical purpose.
