3 आ.अ.सं. 411/इंदौर/2019 तथा अ�य �ीमती बसंती खा�रया, इंदौर तथा अ�य 2. सुनवाई के �ारंभ म� ह�, �नधा�र�तय� के �व�वान अ�धव�ता ने �नवेदन �कया �क �नधा�र�तय� ने “�ववाद से �व�वास योजना” म� आवेदन �कया है तथा योजना के अनुसार, वत�मान अपील� को वा�पस लेना अपे��त है । अतः �नधा�रती वत�मान अपील� का अनुसरण करने के इ�छुक नह� ह� । दूसर� ओर, �व�वान व�र�ठ �वभागीय ��त�न�ध ने कोई आपि�त नह�ं क� है य�द इन अपील� को क�थत योजना के अंतग�त दबाव नह�ं डाले जाने के कारण खा�रज �कया जाता है ।

उपरो�त क� �ि�ट म�, हम �नधा�र�तय� �वारा दा�खल इन अपील� को वा�पस �लए जाने के कारण खा�रज करते ह� । य�य�प, �नधा�रती �व�ध के अनुसार �व�न�हत अव�ध के अंदर आदेश को वा�पस बुलाने (recall) हेतु �व�वध आवेदन दा�खल करने के �लए �वतं� ह�गे य�द संबं�धत �नधा�रती का इस योजना के उपभोग करने हेतु आवेदन राज�व �वारा �कसी कारण से �वीकार नह�ं �कया जाता है या संबं�धत �नधा�रती �कसी कारण से इस योजना म� भाग नह�ं ले पाता है ।
