48. We have considered the rival submissions of both the parties and perused the order of lower authorities carefully. We find that the Assessing Officer treated the foreign exchange fluctuation loss as capital loss as the term loan was availed for acquisition of capital assets and the foreign exchange loss is also of capital in nature. depreciation amount of Rs.7,26,434/- already disallowed and added back by the assessee is reduced from disallowed expense of Rs. 35,77,519/-.
