9. The Revenue took the issue before the Tribunal, who concurred with the ld. CIT(Appeals) and dismissed the appeal. The Hon’ble Madras High Court had reversed the orders of ITAT as well as ld. CIT(Appeals) and held that income of the assessee is to be assessed as a house property income and not a business income
