The assessee placed reliance on the decision of Hon’ble Gujarat High Court in the case of Leena Jugalkishor Shah v. ACIT reported in (2017) 392 ITR 18 (Guj) , wherein Hon’ble Gujarat High Court decided the issue in favour of the tax-payer by holding that deduction u/s 54F shall be allowed for purchasing a residential property outside India.
