Facts
The appellant, a co-operative society, failed to file an ITR for AY 2014-15. The AO initiated reassessment proceedings under Section 148 based on information of a large cash deposit, completed a best judgment assessment, and subsequently, through a Section 154 order, sought to levy tax under Section 115BBE. The CIT(A) had previously set aside the original assessment for fresh adjudication and later confirmed the AO's Section 154 action, leading to the present appeal.
Held
The Income Tax Appellate Tribunal, noting the CIT(A)'s earlier decision to set aside the original assessment, and with no objection from the Revenue, remanded the appeals back to the AO for fresh adjudication in accordance with law, thereby allowing the appeals for statistical purposes.
Key Issues
The key issue concerned the validity of the assessment and the subsequent levy of tax under Section 115BBE via a Section 154 order, particularly after the original assessment was set aside by the CIT(A) for fresh adjudication.
