Facts
The assessee filed appeals for AY 2011-12 and 2012-13. For AY 2011-12, the CIT(A) dismissed the appeal for being time-barred without addressing merits, with the assessee citing the Director's medical illness as the cause for delay. For AY 2012-13, the assessee contended that the CIT(A) did not provide sufficient opportunity to present its case.
Held
The Tribunal condoned the delay for AY 2011-12, acknowledging the medical illness as reasonable cause, and remitted both assessment years (AY 2011-12 and AY 2012-13) back to the CIT(A) for fresh adjudication after providing adequate opportunity of being heard to the assessee. Both appeals were allowed for statistical purposes.
Key Issues
1. Whether the delay in filing the appeal before CIT(A) for AY 2011-12 should be condoned. 2. Whether the assessee was denied adequate opportunity of being heard by the CIT(A) for AY 2012-13.
