depreciation were disclosed in tax audit report, the disallowance of deprecation would not warrants penalty under section 271(1)(C) of the Act. Finally, ld Counsel prays the Bench that penalty imposed by the assessing officer may be deleted. 7. On the other hand, the Ld. DR for the Revenue has primarily reiterated the stand taken by the Assessing Officer
