capital gain is taken up by the A.O. without expansion or conversion of the limited scrutiny to comprehensive scrutiny then such act of A.O. is beyond his jurisdiction and the order passed by the A.O. U/s 143(3) of the Act would be illegal and void ab initio. This Tribunal has taken a consistent view on this issue
