In the result, the appeal filed by the assessee is partly allowed\nfor statistical purposes in terms of our aforesaid observations

It\nwas thus, held that the period available to the assessee for making\nthe investment u/s 54 of the Act will be available up to the period\ncontemplated under sub-section (4) of Section 139 of the Act. We\nthus, in terms of our aforesaid observations, direct the A.O. to\nallow the investment
