Section 260A of the Income Tax Act, 1961 (the Act) is directed against the order 14th August, 2008 passed by the Income Tax Appellate Tribunal, ‘B’ Bench, Kolkata (Tribunal) in ITA No. 237/Kol/2008, for the assessment year 2003-04. The appeal was admitted on 12th January, 2009 on the following substantial questions of law : “a) Whether in view
