CIT(A) has grossly erred on facts and in law in ignoring the specific provisions of section 94(8) of the Income Tax Act and the amendment brought to the same by Finance Act 2022 which was categorically made effective only from 01.04.2023hence ... incurring loss and setting-off against capital gains income is an "abuse of law" cannot be affirmed. 32.
