The Assessing Officer (AO) disallowed the claimed carry forward of business loss of Rs. 1,22,04,26,668/- on the ground that the return was belatedly filed under Section 139(4). The AO initiated penalty proceedings under Section 270A for misreporting of income/loss.
Held
The CIT(A) dismissed the assessee's appeal as there was no response from the assessee despite several opportunities. The Tribunal observed that the CIT(A) had not decided the appeal on merits. Therefore, the Tribunal remanded the matter back to the CIT(A) for fresh consideration.
Key Issues
Whether the CIT(A) was justified in dismissing the appeal without deciding on merit and whether the penalty for misreporting of income/loss was correctly levied.
