Sr. DR submitted that the issues may be restored to the file of ld. CIT(A) after condoning the delay. 5. We have considered the rival submissions. Admittedly, the assessee has shown sufficient cause for the delay in filing of the appeal before the ld. CIT(A). Consequently, we are inclined to condone the delay in filing of the appeal before the ld. CIT(A) and we do so. It is further noticed that the issues are liable to be examined by the Assessing Officer in so far as the assessment order is an ex parte order and this case requires substantial verification of facts. This being so, in the interest of justice, the issues in this appeal are restored to the file of the Assessing Officer for readjudication after granting the assessee adequate opportunity being heard subject to the payment of cost of Rs. 10,000/- deposited with Jharkhand Income Tax Bar Association to be paid within 60 days from the date of issue of this order. In the event, the cost is not paid and the receipt is not produced before the Assessing Officer, at the date of first hearing, the order of the ld CIT(A) shall stand confirmed.
