These appeals by the Assessee and the Revenue for the respective assessment years are directed against separate orders of learned CIT(A), New Delhi.
None appeared on behalf of the assessee at the time of Virtual hearing before us. The leaned counsel for the assessee, vide his letter dated 30th March, 2021, has requested for withdrawal of the appeals filed by him for Assessment Years 2011-12 and 2015-16 and also requested for dismissal of appeals filed by the Revenue for Assessment Years 2011-12 and 2012-13 and stated that the assessee has opted to settle the disputes relating to the tax arrears for all the assessment years under consideration under the “Vivad Se Vishwas Scheme, 2020”. A certificate to this effect under Section 5(1) of The Direct Tax Vivad Se Vishwas Act, 2020 has also been filed in the appeals for assessment years under consideration. Copies of Form No.3 has been filed in respect of Departmental appeals which shows that no tax is payable.
Learned Senior DR has no objection.
In view of the above, we accept the request of the assessee for withdrawal of the appeals filed by the assessee and dismissal of appeals filed by the Revenue having been infructuous.
In the result, the appeals filed by the Revenue as well as by the assessee are dismissed.
